This Tr.C.M.P is filed by the petitioner-wife seeking transfer of H.M.O.P.No.275 of 2015 on the file of the Principal Subordinate Judge, Trichy (Camp Court, Thuraiyur) to the file of the Principal Sub Judge, Cuddalore.
2. H.M.O.P.No.275 of 2015 has been filed by the respondent-husband for divorce before the Principal Sub Court, Trichy. It is stated that the petitioner is presently residing in Cuddalore with her parents. She finds it difficult to travel to Trichy all the way from Cuddalore, which is about 260 kms away from Cuddalore. She feels that she being a woman, needs a person to accompany her to Trichy for attending the Court hearings. Since her parents are aged, they are unable to accompany her to attend the Court hearings. It is also further stated that the petitioner does not have any source of income and hence, she could not afford expenses to go to Trichy. Hence, she prays for transfer.
3. Heard the learned counsel appearing for the petitioner and perused the materials available on record.
4. Though the respondent had been served with notice and his name having been printed in the cause list, there is no representation for the respondent, either in person or through counsel.
5. In the Transfer cases, the convenience of the wife should be given preference for attending her case hearings and also taking into consideration the above facts and the grievances expressed by the petitioner, the Tr.C.M.P. is ordered and H.M.O.P.No.275 of 2015 pending on the file of the Principal Subordinate Judge, Trichy, shall stand withdrawn and transferred to the Principal Subordinate Judge, Cuddalore. No costs. Consequently, connected miscellaneous petition is closed.
