The petitioner herein has been convicted by the learned III-Additional District and Sessions Judge (Fast Track Court) at Nizamabad, in Sessions Case No.66 of 2009 and he was sentenced to undergo imprisonment for life. He preferred Criminal Appeal No.777 of 2010 there against, which is pending in this Court. In view of certain peculiar circumstances, bail was granted by this Court by an order passed in Crl.A.M.P.No.559 of 2014 by a Division Bench on 16.04.2014 with a condition that he shall surrender before the jail authorities latest by 5.00 P.M. on 23.04.2014.
It is the case of the petitioner that the State Government grated him parole for a period of 30 days and accordingly he has been released from the custody by the Superintendent, Central Prison, Nizamabad, on 01.08.2014. He was directed to surrender on 01.09.2014. But, however, in view of pendency of the representation said to have been submitted by him to the Hon’ble Chief Minister of Telangana State on 16.08.2014, he has not surrendered before the Superintendent, Central Prison, Nizamabad. It is the case of the petitioner that through the said representation addressed to the Hon’ble Chief Minister, Government of Telangana, he sought for extension of parole by 60 days. However, it is alleged by the petitioner, who appeared in person, that no orders have been passed by the State Government on his extension of parole application.
Be that as it may, in the facts and circumstances narrated by the petitioner including the deteriorating health condition and hospitalization of his mother, I consider that the ends of justice would be met adequately if the petitioner is granted extension of parole till 15.09.2014, by which date I hope and trust that the Government would deal with his representation dated 16.08.2014 and would pass appropriate orders and communicate the same to the petitioner. For any reason, if the Government refuses to grant extension or restricts the extension till 15.09.2014, the petitioner shall surrender before the Superintendent, Central Prison, Nizamabad, latest by 5.00 P.M. on 15.09.2014.
The Writ Petition stands disposed of with this order after hearing the learned Assistant Government Pleader for Home, State of Telangana. Miscellaneous Petitions pending, if any, in this writ petition shall also stand closed. No order as to costs.
