DAMODAR REDDY COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to release the petitioner on bail pending enquiry and trial in Cr.No. 8 of 2014 of Yellandu Police Station, Khammam, Khammam District.
The Court made the following Order:
“The petitioner is A-2. She seeks for grant of bail. She allegedly committed offences under Section 420 IPC, Section 4 of the Chit Funds Act and Section 5 of the Protection of Depositors of Financial Establishments Act, 1999.
The prosecution alleged that A-1 to A-4 swindled and cheated the public to a tune of more than Rs.1,20,00,000/-.
31 witnesses have already been examined by the investigating agency.
Learned counsel for the petitioner submitted that the main culprit, even according to the prosecution, is A-4 and that A-2 is innocent of the offences levelled against her.
In view of the nature of the offences levelled against the petitioner and in view of the fact that the petitioner is a lady, I consider it appropriate to enlarge the petitioner on bail.
Consequently, the Criminal Petition is allowed. The petitioner-A2 is enlarged on bail on a personal bond of Rs.10,000/- (Rupees ten thousand only) with two sureties in a likesum each to the satisfaction of the Judicial First Class Magistrate at Yellandu, Khammam District.
