Learned counsel for both the parties are in agreement that the issue involved in the present petition is as to whether the services rendered prior to the regularization are to be considered for the purpose of commutation of pension is squarely covered by the judgment and order dated 24.7.2018 passed in Writ-A No.14970 of 2018, (Narsingh Rai Vs. Deputy Director of Education, Varanasi & 3 Ors), wherein said issue is being decided in affirmity.
Learned counsel for both the parties prayed that this writ petition may be disposed of in terms of the abovementioned judgment.
The order impugned dated 12.2.2019 passed by the respondent no.4, is set-aside.
This writ petition is disposed of in terms of the judgment and order passed in Writ-A No.14970 of 2018, Narsingh Rai (supra).
