Petition filed under Section 438 Cr.P.C.
2. According to the petitioner, he is apprehending arrest in connection with Crime No.362/2014 of the Kolathur Police Station, Malappuram registered for the offences punishable under Section 379 of the Indian Penal Code and Sections 20 and 23 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001.
3. Heard learned counsel for the petitioner and the learned Public Prosecutor.
4. The learned Public Prosecutor submits that even though the petitioner was arraigned as the accused in the case, on investigation, he was removed from the array of B.A.No.8441 of 2014 -: 2 :-
the accused and presently, he is not an accused.
In the result, this Bail Application is closed accordingly.
