Petitioner is accused in Crime No.12 of 2013 of the Excise Range Office, Thalassery for the offence punishable under Section 20(b)(ii)(B) of the NDPS Act, 1985 for alleged possession of 2.100 kgs of ganja on 04.07.2013, is in custody since then and seeks bail.
2. Learned Public Prosecutor has opposed the application. It is submitted that petitioner was initially released on bail in the aforesaid crime and while on bail, got involved in Crime No.20 of 2013 of the same Excise Range for possession of 04.00 kgs of ganja. Bail granted to the petitioner was cancelled.
3. Learned counsel submits that the allegations are not true.
4. It is revealed that while the petitioner was on bail in the present case he was arrested for (allegedly) possessing 4 kgs of ganja. Having regard to the materials on record and B.A.No.4334 of 2014 2 circumstances stated above, request for bail cannot be allowed.
Application is dismissed.
