The Original Petition is filed challenging the order passed by the Central Administrative Tribunal rejecting O.A.No.260 of 2014 filed by the petitioner.
2. The petitioner was a Multi Task Staff in Rail Mail Service at Thiruvananthapuram. According to him, as is evident from Annexure-A7, his date of birth is 07/10/1954 and that on that basis he is liable to be retired from service only on 31/10/2014. It is stated that despite this, on 31/3/2014 he was given a sent off and he is not permitted to work from 01/4/2014. It was in such circumstances he filed the Original Application, requiring the respondents to permit him to continue in service till 31/10/2014.

However, before the Tribunal, respondents contended that the date of birth of the petitioner as entered in the service record was 05/03/1954 and that if so he was liable O.P.(CAT).No.159 of 2014 2 to have been retired from service on 31/3/2014. They also produced Annexure-R3 a nomination made by the petitioner for new pension scheme where his date of birth was indicated by him as 05/03/1954. It was in these circumstances, the Tribunal rejected the Original Application.
4. Having gone through the pleadings of the parties, we notice that the petitioner himself had declared his date of birth as 05/03/1954. The date of birth so declared by him continued in his service records, through out and therefore the petitioner was liable to be superannuated from service on 31/3/2014, the end of the month in which he attained 60 years of age.
5. We do not find any illegality in the action of the respondents. Therefore, the Tribunal was fully justified in dismissing the Original Application.
Hence, the O.P.(CAT) is dismissed.
