JUDGMENT / ORDER

The petitioner is the holder of building permit for constructing a residential building.
2. In view of Ext.P2 Government Order, the petitioner does not require permit for extracting ordinary earth from the site covered by the building permit. However, for the purpose of transporting ordinary earth, the petitioner requires 'P form.
Accordingly, there shall be a direction to the first respondent to issue 'P form' on being satisfied with the genuineness of the claim of the petitioner based on the building permit without insisting for No Objection Certificate. Needful shall be done within a period of ten days from the date of receipt of a copy of this judgment. If the petitioner fails to undertake any construction based on Ext.P1, the Geologist W.P.(C) No.30677 of 2014 2 shall take appropriate action against the petitioner for contravening the Minor Mineral Concession Rules. The petitioner shall produce a copy of this judgment before the first respondent for compliance.
The writ petition is disposed of as above.
