One Krishnan Nair approached the Forest Tribunal, Palakkad in O.A.No.546 of 1976. The subject matter of O.A was an extent of 1.10Acre of land in Survey No.54/1 in Ottapalam-II Village in Ottappalam Taluk. The petitioners claim to be the legal heirs of Krishnan Nair. According to the petitioners, 1.10Acres in Survey No.54/1 was exempted from the purview of Kerala Private Forest (Vesting and Assignment Act) 1971. It is further submitted that no appeal has been preferred against the judgment in O.A.No.546 of 1976. Petitioners grievance is that forest authorities fail to deliver the property exempted pursuant to the judgment in O.A.No.546 of 1976.
2. On behalf of the third respondent, a statement has been filed. It is stated that the 4th respondent, Assistant Director of Survey has been requested to survey the above area and forward a sketch. Therefore, after obtaining the sketch, the land in question will be restored to the petitioner's position.
3. In view of the above, the 4th respondent is directed to complete the survey and issue a sketch to the third respondent W.P(C).No.25252 of 2014F 2 within a period of two months from the date of receipt of a copy of this judgment. Thereafter, the third respondent shall take necessary steps to restore the land to the petitioners within a further period of two months.
The Writ Petition is disposed of as above.
