The limited prayer made by the learned counsel for the petitioner when this matter was taken up for admission, is for a direction to the second respondent to consider Ext.P12 appeal.
2. Ext.P12 is an appeal preferred by the petitioner against Ext.P4 assessment order under the Building and other Construction Workers Welfare Cess Act, 1996. Ext.P12 appeal being a statutory one, I deem it appropriate to grant the limited prayer sought by the petitioner.
In the result, the writ petition is disposed of directing the second respondent to consider Ext.P12 appeal within two W.P.(C)No.14731 of 2016 2 months from the date of receipt of a copy of this judgement. Needless to say that until a final decision is taken on Ext.P12 appeal, further proceedings pursuant to Ext.P4 shall be kept in abeyance.
