Application filed under Section 439 of the Code of Criminal Procedure.
2. Petitioner is the 1st accused in Crime No.143 of 2003 of the Pettah Police Station registered for the offences punishable under Sections 143, 147, 148, 201, 120B and 302 r/w Section 149 of the Indian Penal Code.
3. It seems that presently the case is pending trial as S.C.No.1043 before the Additional Session's Court-V, Thiruvananthapuram. The petitioner has been custody for the period from 31.08.2014 onwards.
4. Heard the learned counsel for the petitioner and the learned Senior Public Prosecutor.
5. Learned Senior Public Prosecutor has pointed out that the petitioner was absconding for a pretty long period and hence the delay in the disposal of the case has occurred. It has also been pointed out that he has serious criminal antecedents and he is accused in 7 other serious crimes. Further, he was undergoing detention in KAAPA also. Learned Senior Public Prosecutor has pointed out that presently the case stands B.A.No.7906 of 2014 2 scheduled for trial to 17.11.2014 onwards.
Considering all the above, I am satisfied that the petitioner is not entitled to be enlarged on bail.
In the result, this bail application is dismissed.
