JUDGMENT / ORDER

This Crl.M.C has been filed with a prayer to quash Annexure A1 FIR in Crime No.1035/2014 of Tripunithura/Hill Palace Police Station, Ernakulam District as against the petitioner, who is the 2nd accused in the aforementioned case. The only offence against the petitioner is one under Sec.498(A), which constitutes that the offence involved has been committed by the husband or relative of the husband of the woman subjected to cruelty. It is submitted that the petitioner herein is in no way related to the husband of the lady de facto complainant and therefore, it is too well established that no offence would lie as against such a person. The learned Public Prosecutor had taken time to get instruction in the matter on the previous occasion. The learned Public Prosecutor would fairly submit that the Investigating Officer has taken steps to delete the petitioner herein as accused No.2 from the accused array in the aforementioned crime No.1035/2014 of the Tripunithura/Hill Palace Police Station and that necessary formalities in that Crl.M.C.No.5777 of 2014 2 regard is completed and the petitioner has been deleted from the accused array and final report has been filed before the competent Court after deletion of the petitioner from the accused array. In this view of the matter, nothing survives in this case and accordingly this Crl.M.C is closed recording to the submission of the prosecution.
