Heard learned counsel for petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"(i) Issue a order or direction in the nature of mandamus directing the respondent no. 1 learned Sub-Divisional Magistrate, Handia, District- Prayagraj to decide the Case No T 021902030401584 of 2018 (Sitavi Devi Versus Photo Devi), Under Section-116 U.P. Revenue Code, Pargana- Mah, Tehsil- Handia, District- District- Prayagraj."
It is stated by the counsel for the petitioner that the case under Section 116 of the Act filed by the petitioner is pending consideration since the year 2018. From the material on record it transpires that till date, only time has been sought for filing written statement.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 1, Sub Divisional Magistrate (in short 'SDM'), Handia, Prayagraj to consider and decide the case expeditiously, preferably within a period of 18 months from the date of production of a certified copy of this order before him.
