COMMON ORDER:
These writ petitions have been filed by different HT consumers of respondent No.1 feeling aggrieved by the bills issued by respondent No.3 and notices issued by respondent No.2 for payment of certain amounts under the head ‘other charges’.
On 07.11.2014, this Court while ordering notices has granted interim orders staying disconnection of power supply.
Today, at the hearing, Sri O.Manohar Reddy, learned Standing Counsel appearing for respondent Nos.1 to 3, has submitted that as the petitioners have raised a dispute before respondent No.4 under Section 42(5) of the Electricity Act, 2003 the said respondent may be directed to adjudicate the same.
Considering the above submission of the learned Standing Counsel, I am of the view that it would be appropriate if respondent No.4 decides the dispute after notice to both the parties. Accordingly, respondent No.4 is directed to decide the dispute within one month from the date of receipt of a copy of this order, after notice to both the parties. Till the dispute is decided and orders are communicated to the petitioners, interim orders, dated 07.11.2014, staying disconnection of power supply shall continue.
Subject to the above direction and observation, the writ petitions are disposed of.
As a sequel to disposal of the writ petitions, pending interlocutory applications shall stand disposed of as infructuous.
