JUDGMENT / ORDER

Heard Shri S.C. Verma, learned counsel for the petitioner as well as learned standing Counsel.
The petitioner has prayed for issuing a writ of mandamus commanding the Director Ayurvedic Services U.P. Lucknow to participate in the ongoing counselling on the basis of the Government Order dated 23.5.2014.
The learned counsel for the petitioner admits that the petitioner posted the application on 9th June, 2014 and it was received in the office of opposite party no. 2 on 4th July, 2014, but it has been refused to accept with the endorsement;

The said endorsement made on the postal envelope has been brought on record as annexure no. 7. A bare perusal of the same shows that it has been returned to the sender by the Post Office itself. Thus, it is established that the application had not reached the office of the opposite party no. 2.
Therefore, keeping in view the fact that petitioner's application could not reach in the office of the opposite party no. 2 by the last date of submission of application. I am of the view that there is no occasion to allow him to appear in the counselling.
In the result the writ petition stands dismissed.
