JUDGMENT / ORDER

It has been informed that the learned counsel appearing for the petitioner is on sanctioned leave. However, considering the prayer made in this petition, the Court proceeds to decide the same.
A suit under Section 116 of the U.P. Revenue Code, 2006 seeking partition of land in dispute has been instituted by the petitioner before the learned trial court, namely, the court of Sub Divisional Officer, Kadipur, District Sultanpur on 06.06.2018.
From the pleadings available on record, it is not clear as to what is the stage of the proceedings at the moment of the said suit filed seeking a decree of partition of the land holding.
However, having regard to the proposed order, requirement of issuance of notice to the respondent Nos. 2 to 7 is hereby dispensed with.
Considering the innocuous nature of prayer made herein, the writ petition is finally disposed of with the direction to the court concerned to expedite the proceedings of the Suit bearing No. T-201904680401340, under Section 116 of U.P. Revenue Code, 2006, Sitaram Vs. Bhaggu and others and conclude the same in accordance with law and after affording opportunity of hearing to all concerned within a maximum period of 12 months from the date of production of certified copy of this order before the court concerned.
It is further directed that parties to the proceedings before the court concerned shall not seek any unnecessary adjournments and adjournment, if prayed for, shall be permissible to be granted by the court concerned only in exceptional circumstances.
