(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) This is an application for condonation of delay of 89 days in filing Letters Patent Appeal.
Heard learned counsel Mr. Bhavesh B. Choksy for the applicant and Ms. Tejal Shah holding brief of Ms. Roopal R. Patel appearing for respondent No.1. Rule has been served on other respondents.
2. Considering the contents of the application, it cannot be said that the delay caused in filing the Appeal has remained totally unexplained. Therefore, we are of the view that the delay caused in filing Letters Patent Appeal deserves to be condoned. Accordingly, the application is allowed. Delay is condoned. Rule is made absolute.
3. Office is directed to notify Civil Application (Stamp) No.4614 of 2012 for admission hearing on 9.5.2012.
