Court No. - 33
Case :- WRIT - A No. - 9916 of 2021 Petitioner :- Sirpati Respondent :- Commissioner, Navodaya Vidyalaya Samiti And Another Counsel for Petitioner :- Srestha Pandey Counsel for Respondent :- Rajesh Tripathi
Hon'ble Ashwani Kumar Mishra,J.
Petitioner claims to be the wife of late Chandra Bhan, who was a Class IV employee in Jawahar Novodaya Vidhyalaya, Jiyanpur, Azamgarh. It appears that after death of the employee concerned his son has been offered compassionate appointment. According to petitioner, there was an agreement that 50% of the salary would be paid by the second respondent to the petitioner and this compromise is not being acted upon.
Sri Rajesh Tripathi has appeared for respondent no. 1 and states that compassionate appointment has been granted to respondent no. 2 on 30th September, 2010 and he is working as such. It is also stated that petitioner is not recorded as a member of the family.
Be that as it may, petitioner wants enforcement of the agreement arrived at between respondent no. 2. This Court is not the appropriate forum for enforcing such settlement, nor the respondent no. 1 would be the competent authority to do so.
The writ petition is wholly misconceived and is accordingly dismissed.
