Heard learned counsel for the petitioner; Shri Sanjay Kumar Singh, learned Standing Counsel for the State respondent and Shri D.D. Chauhan, learned counsel for the Land Management Committee (fourth respondent).
Petitioner is before this Court with the request to command the Sub Divisional Officer, Tehsil Rudhauli, District Basti (second respondent) to take immediate action on the application of the petitioner filed under Section 101 of U.P. Revenue code, 2006 in respect of her bhumidhari land being Gata no.126M area 0.038 hectare with the land of Gram Sabha being Gata no.186 area 0.038 hectare situated at Village Deora, Pargana Maghar Paschim, Tehsil Rudauli, District Basti.
Learned Standing Counsel and Shri D.D. Chauhan, Advocate very fairly state that in case the aforesaid application is still pending, the same shall be considered and decided by the Authority concerned expeditiously.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Sub Divisional Officer, Tehsil Rudhauli, District Basti to expedite the hearing of the aforesaid application and conclude the same expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost but certainly after according opportunity of hearing to all the stake holders in the matter.
