This writ petition was filed challenging the action of the respondents in insisting the petitioner to give up prosecution in Crime No.95 of 2010 of Penumantra Police Station, West Godavari District.
2. On written instructions, the learned Assistant Government Pleader for Home states that after registration of Crime No.95 of 2010 for the offences under Sections 354, 323 and 506 read with 34 IPC against six persons, investigation was conducted. The statements of the complainant and eight (8) other witnesses were recorded and their statements do not support the version of the complainant. The investigation revealed that the petitioner lodged a false complaint against the accused. After obtaining permission from the Sub- Divisional Police Officer, Narsapur, vide C.No.911/Refer/SDPO- N/2010 dated 30.10.2010, and serving notice on the complainant a final report was filed on 16.11.2010 before the concerned Court reporting that the complaint is false.
3. In view of the statement made by the learned Assistant Government Pleader for Home on the basis of written instructions, nothing survives for adjudication in this writ petition and the same is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
