JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 61356 of 2015 Petitioner :- Sirajul Hasan & Another Respondent :- State Of U.P. & 2 Others Counsel for Petitioner :- Rajeev Misra,Prashant Kumar Tripathi Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J. Hon'ble Neeraj Tiwari,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present. In the circumstances, we ourselves have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"1. Issue a writ, order or direction in the nature of certiorari quashing the G.O. dated 19.10.2012 (Annexure No. 8 to the writ petition) issued by the respondent no. 1 the Principal Secretary, Department of Finanace U.P., Lucknow in so far it provides the implementation of the recommendations made in the 10th Chapter (part 6) of the recommendations made by the pay committee 2008 with regard to the employees of the Local Fund Audit Department from the date of the G.O. dated 19.10.2012.
2. Issue a writ, order or direction in the nature of mandamus commanding the respondents to extend the benefit of the recommendations made in the 10th Chapter (part 6) of the recommendations made by the pay committee 2008 with regard to the employees of the Local Fund Audit Department in terms of the G.O. dated 14.06.2012 issued by the respondent no. 1 (Annexure No. 6 to the writ petition)."
3. We ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 30.4.2018 Arvind
