The suit of the plaintiffs/respondents for permanent injunction in respect to the land in dispute was dismissed by the court of first instance holding that he is unable to prove title and possession over the land in dispute. However, in appeal the judgment and order of the lower court has been set aside and the suit has been decreed.
The submission of learned counsel for the defendant/appellant is that the appellate court has reversed the finding without referring even to the survey commission report in so far as the identity/location of the land was dispute.
Issue notice to the respondents no. 1 and 2 by registered post.
Unless further orders of this court parties are directed to maintain status quo with regard to the possession over the land in dispute.
