Heard learned counsel for the petitioners, learned Standing Counsel and perused the record.
The present writ petition has been filed with the prayer to issue a writ, order or direction in the nature of mandamus commanding/directing the respondents to initiate an impartial inquiry by any independent agency to verify the serious allegations of facts and provide safety to the life and safety of the petitioners and their family, otherwise the respondents can cause irreparable loss and injury in the manner they are acting with the petitioners with further prayer to direct the respondents not to interfere in the peaceful life of the petitioner and further not to take any coercive measure against the petitioners unless in accordance with law during pendency of the instant writ petition.
Learned counsel for the petitioners submitted that petitioner no.3 has performed inter-caste marriage with petitioner no.4 daughter of respondent no.6. The first information report was lodged in November, 2017, which was quashed by the High Court, however, there is harassment by the respondents as the respondent no.6 are giving colour of communal of that marriage. There was a threat to the petitioners to implicate in false cases. The petitioners have no criminal history hence direction be issued to provide security and not to harass the petitioners.
Learned Standing Counsel opposed the aforesaid prayer.
Considered the submissions of learned counsel for the parties. Admittedly the first information report was lodged and has already been quashed hence there is no question of taking any action against the petitioners. However, if there is violation of law or any action is taken against the law then the petitioners will have liberty to approach the authority concerned including the court concerned seeking appropriate remedy, in accordance with law. At this stage, no such direction is required.
Accordingly, present writ petition is hereby dismissed.
