Siptain Ali vs State Of U.P.

High Court Of Judicature at Allahabad|09 September, 2014

JUDGMENT / ORDER

Heard Sri Zaid Arshad, learned counsel for the applicant and Sri Akhilesh Singh, learned Government Advocate assisted by Sri Vikas Sahai, learned AGA for the State.
In compliance of the Court's order dated 2.8.2014 and 6.9.2014 respectively, the SSP, Allahabad Sri Deepak Kuamr has filed affidavit of compliance. He is also present in compliance of the courts order, today in the Court.
The explanation given by the SSP, Allahabad for not responding the fax dated 11.8.2014 in compliance of the courts dated 2.8.2014, has been reasonably explained and he has also taken necessary steps against the erring official for not informing him about the High Court's order for filing counter affidavit in the matter.
Learned Government Advocate states that he wants at least four weeks time to obtain necessary instructions in the matter from the competent authorities and crime in question which is an organized crime. He is allowed four weeks' further time to seek necessary instructions in the matter and on the supplementary affidavit which has been filed by the counsel for the applicant.
List this matter after four weeks.
The Court has come across that in bail matters pertaining to district Allahabad, the instructions are not received by the Government Advocate in time for which on several occasions the learned AGA were given further time for instruction which delay the early disposal of bail application. The said fact was apprised of to the SSP, Allahabad who has assured this Court that he will look into the issue and ensured that the instructions are received by the Government Advocate within the mandatory periods of 10 days for which time is given to the Government for seeking information.
The presence of SSP, Allahabad is hereby dispensed with.
