This is defendant's petition.
Only prayer made in the present petition is to issue a direction to the trial court to decide the application under Order 39 Rule 4 of the Code of Civil Procedure seeking for recall/revocation of the exparte injunction order dated 11.07.2018. It is demonstrated by learned counsel for the petitioners/defendants that they had filed a written statement on 07.08.2018.
Having perused the order sheet, without expressing any opinion as to the merits of the claim made by the petitioners, the present petition is being disposed of with the direction to the trial court namely Additional Civil Judge (J.D.), Allahabad to decide the application filed under Order 39 Rule 4 of the Code of Civil Procedure in Original Suit No.1713 of 2018 (Gram Panchayat Vs. Sipahi Lal & others) preferably on the next date fixed or on a date of fixed within a period of three weeks, thereafter, without granting any unnecessary adjournment to any of the parties.
