Singireddy @ Giruka Hymavathi … Respondent THE HON’BLE SRI JUSTICE SANJAY KUMAR CIVIL REVISION PETITION NO.1497 OF 2014 O R D E R The learned II Additional Senior Civil Judge, Warangal granted maintenance of Rs.5,000/- per month to the respondent-wife in O.P. No.17 of 2012 on an application filed by her for interim maintenance in I.A. No.609 of 2012 in O.P. No.17 of 2012. Aggrieved thereby, the petitioner in the OP, the husband, is before this Court under Article 227 of the Constitution.
2. The petitioner filed the subject OP seeking divorce from his wife under Section 13(1)(i)(i-a) of the Hindu Marriage Act. The respondent- wife sought interim maintenance by filing the subject IA in the OP. Taking into account the fact that the husband was a qualified engineer and was working as a software engineer, the Court below granted maintenance at Rs.5,000/- per month in lump sum for the upkeep of the wife and the minor daughter.
3. Though the petitioner-husband contended that he lost his job owing to the criminal complaint filed by the wife, he did not adduce any evidence before the Court below to substantiate the same. No petition has been filed before this Court to adduce additional evidence in this regard. That apart, this Court is of the opinion that fixation of interim maintenance at Rs.5,000/- per month is not exorbitant given the fact that the wife and the child are residing at Hyderabad. The order of the Court below does not brook any interference.
3. The CRP is accordingly dismissed. In the interests of the parties, the Court below is requested to endeavour to dispose of the OP expeditiously. No order as to costs.
