1. The present petition is directed against the impugned order dated 4.1.2011 passed by Labour Court, Ahmedabad in Application No.533/1997 below Exh.17, whereby the Labour Court, Ahmedabad directed the present petitioner to pay lump sum compensation of Rs.25,000/- to the respondent and also the order dated 21.5.2011 passed by the Industrial Court in Appeal (IC) No. 6/2011 with Appeal (IC) No.5/2011,whereby the appeals preferred by the petitioner and respondent came to be rejected.

The respondent no.1 herein challenged the alleged order of termination dated 07.07.1997 before the Labour Court under the provisions of Bombay Industrial Relations Act, 1946, which came to be registered as being Application No.533/1997. The petitioner resisted the said application. The Labour Court, Ahmedabad passed an order directing the petitioner to pay a lump sum amount of Rs.25,000/-. Feeling aggrieved by the said order dated 4.1.2011 the petitioner preferred an appeal being Appeal (IC) No. 6 of 2011 in Application No.533/1997. The respondent also preferred an appeal before the Industrial Court which came to be rejected as Appeal (IC) no. 5 of 2011. After hearing the parties the Industrial Court raised the amount to Rs. 60,000/-. It is against the said order that the present petition has been filed.
3. As a result of hearing and perusal of the record it is found that the Appellate Court has considered all the relevant details. As per the record the workman joined the duty on 18.10.1983 and he worked till 7.7.1997. Therefore it was found that the amount awarded is on lower side and the appellate court has raised the amount to Rs.60,000/-. I am in complete agreement with the reasoning adopted and findings arrived at by the Industrial Tribunal. No case is made out to cause interference. Hence the petition is dismissed.
