Petitioner filed this Writ Petition alleging that his fiancee Sarika.S.Nair is being illegally detained by respondents 4 and 5 in order to prevent her from getting married to him. Considering the nature of the allegations and also the report obtained from the 1st respondent, this Court passed an order dated 16.6.2014 directing the production of the detenue before us today. Accordingly, she was produced before us and we interacted with her. In answer to our questions, she told us that she is now residing with the sister of her mother and that her residence with her aunt is a voluntary one. She has confirmed that she is not being illegally detained by respondents 4 and 5.
2. The facts now disclosed by the detenue herself proved the allegation of the petitioner that she is being illegally detained by respondents 4 and 5 is incorrect. In such a situation, this Court cannot entertain this Writ Petition with the W.P.(Crl) No.241/2014 2 prayer to issue a writ of habeas corpus.
The Writ Petition fails and accordingly it is dismissed.
