Heard learned counsel for the petitioners and learned A.G.A. The relief sought in this petition is for quashing the FIR registered as case crime no. 16 of 2010 under Sections 363/366 I.P.C. P.S. Lalkuirti District Meerut. Learned counsel for the petitioners submitted that the petitioner no.1 Smt. Simran is major and she married with petitioner no.2 Himanshu Arora out of her own sweet-will. It is further submitted by learned counsel for the petitioners that Smt. Simran and Himanshu Arora are present in the Court. Issue notice to respondent no. 3, who may file counter affidavit within four weeks. Learned AGA may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks. List thereafter before the appropriate Bench. The petitioners are directed to produce Smt. Simran before the concerned Magistrate within 15 days. The Magistrate concerned shall get Simran medically examined to ascertain her age. He shall also record her statement under Section 164 Cr.P.C after intimation to the complainant. The arrest of the petitioners is stayed for a period of six weeks.
It shall not be treated as tied up or part heard with this Bench and shall stand released from the order of assignment. Order Date :- 3.2.2010 GNY
