This writ petition is filed with a prayer to quash Ext.P6 notice issued by the Grama Panchayat directing the petitioner to demolish the building constructed in a property, which according to the Panchayat is in gross violation of the building permit granted in his favour. It is, inter alia, observed that the building has been constructed in a property in Survey No.277/5 which belongs to some other person. This fact is disputed by the petitioner. 2. Considering the nature of the judgment being passed in this writ petition, no notice need be issued to the respondents herein.
3. Since Ext.P6 is appealable, the remedy available to the petitioner is to approach the competent appellate authority. Having regard to the fact that there is an eminent threat of demolition of the building before filing of the appeal, the petitioner seeks for some time to prefer the appeal.
W.P.(C)No.26327 OF 2014 : 2 :
Accordingly, this writ petition is disposed of as under:
Petitioner shall file necessary appeal before the Tribunal for Local Self Government Institutions within a period of three weeks from the date of receipt of a copy of this judgment and obtain appropriate orders and in the meantime, further proceedings pursuant to Ext.P6 shall be kept in abeyance.
