----------------------- The petitioner was given a permit by the Geologist as per Ext.P2 to remove 250 cubic meter of ordinary earth from the land situated in Survey No.883/1. The petitioner submits that the 6th respondent raised a complaint and based on that complaint, the petitioner was orally instructed not to transport any ordinary earth from the site covered by Ext.P2. Challenging the above direction, the petitioner has approached this Court.
2. The petitioner submits that he is the owner of building permit and based on that Ext.P2 permit was issued by the Geologist. Considering the fact that Ext.P2 is issued to the petitioner to remove 250 cubic meter of ordinary earth, the petitioner is free to transport ordinary earth quantifying 250 cubic meter from the site mentioned in Ext.P2.
3. The petitioner submits that the validity of Ext.P2 will expire on 5.12.2014 and on account of oral direction, he is unable W.P.(C).No.32584 of 2014

to transport ordinary earth from the site covered under Ext.P2. In view of the above, period mentioned in Ext.P2 is extended till 12.12.2014. However, it is made clear that the petitioner shall not make further quarrying other than what is permitted in Ext.P2 without obtaining permission.
The writ petition is disposed of as above.
