----------------------- Petitioner’s vehicle bearing Reg.No.KL.17-D-2124 has been seized by the 2nd respondent alleging transportation of river sand without valid permit. Petitioner submits that the 2nd respondent has not filed the report of seizure of vehicle before the competent Jurisdictional Magistrate.
2. In view of the above, there shall be a direction to the 2nd respondent to report the seizure of the vehicle before the competent Jurisdictional Magistrate within three days from the date of receipt of a copy of this judgment. If the petitioner makes an application, before the competent jurisdictional Magistrate for the interim custody of the vehicle under Section 23 A of the Kerala Protection of River Banks and Regulations of Removal of Sand Act, the Magistrate shall consider the application within a period of ten days from the date of moving such application. The 1st respondent shall finalise the entire proceedings relating to the confiscation of W.P.(C).No.30078 of 2014

vehicle within a period of two months from the date of receipt of a copy of this judgment after affording an opportunity of hearing to the petitioner.
Writ petition is disposed of as above.
