At the interlocutory stage, this Civil Miscellaneous Appeal (CMA) is taken up for hearing and disposal with the consent of the learned Counsel for the parties.
This Civil Miscellaneous Appeal arises out of Order and Decree, dated 14-11-2011, in IA.No.774 of 2011 in OS.No.15 of 2011, on the file of the Court of the learned Senior Civil Judge, Manthani, Karimnagar District.
The learned Counsel for the respondent stated that the suit, from out of which the present CMA arises, was disposed of by Judgment, dated 17-07-2012, which is styled as an Order by the Senior Civil Judge, Manthani. A perusal of the same would show that the suit was dismissed for default on 17-07-2012. In view of the same, the cause in the CMA does not survive for adjudication and the same is, accordingly, dismissed as infructuous.
As a sequel, interim order, dated 13-03-2012, is vacated and CMAMP.Nos.596 of 2014 in/& 320 of 2012 are dismissed as infructuous.
