… Petitioner … Respondent This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to set aside the notice dated 29.12.2018 marked as Annexure-S and etc,.
This Petition coming on for Preliminary Hearing, this day, the Court made the following:-
ORDER Sri.Vasanth Adithya J, learned counsel for the petitioner.
Taking into account the order which this Court proposes to pass, it is not necessary to issue notice to the respondent.
In this petition, the petitioner inter-alia has prayed for the following reliefs:
“1. Issue a direction in nature of a writ setting aside the notice dated 29-12-2018 marked as Annexure-S;
2. Issue a direction to the respondent to restructure the loan in the interest of justice and equity; and 3. Any other relief or reliefs as this Hon’ble Court may deem fit on the facts and circumstances of the case in the interest of justice and equity.”
2. Learned counsel for the petitioner submits that the petitioner is interested in restructuring his loan account and in this regard, the petitioner has submitted a representation dated 17.11.2018 to the Chief Manager, Vijaya Bank, Bengaluru and the writ petition may be disposed of with a direction to the aforesaid Authority to consider and decide the representation submitted by the petitioner for restructuring the loan account.
3. In view of the aforesaid submission and in the facts of the case, the writ petition is disposed of with a direction to the respondent Bank to consider and decide the representation submitted by the petitioner for restructuring the loan account by a speaking order within a period of four weeks from the date of receipt of the certified copy of the order passed today in accordance with law.
It is made clear that this Court has not expressed any opinion on the merits of the case.
