When this Criminal Original Petition was taken up, an affidavit was produced before this Court duly signed by the second respondent / complainant, in which it is stated that during trial, there was a negotiation between him and the petitioners / accused by the elders of the locality and the amount cheated by the petitioners was received by him. It is further stated that full and final settlement had been arrived at and hence the complainant has no objection for quashing the proceedings in respect of C.C.No.181 of 2015 on the file of the Judicial Magistrate Court-II, Poonamallee.
2. The first petitioner representing all the petitioners and the second respondent / complainant are present. Their identities have been verified and they accepted the contents in the said affidavit as true and genuine.
3. The affidavit filed by the second respondent / complainant, is recorded and the same shall form part of this order. In view of the affidavit filed by the complainant, the proceedings in C.C.No.181 of 2015 on the file of the Judicial Magistrate-II, Poonamallee, against the petitioners, is quashed.
4. The Criminal Original Petition is disposed of accordingly.
Consequently, the connected miscellaneous petition is closed.
