JUDGMENT / ORDER

The petitioner is aggrieved by Ext.P5 detention order. The detention of goods attempted to be transported inter- State was on the ground that, the goods transported was not authorized as per the registration certificate. The learned counsel for the petitioner points out that, the goods transported is X-ray equipment and the registration certificate specifically speaks off medical goods and the annexure attached shows that 'electro medical goods' is one of the items which is permitted to be purchased inter-State. However, the learned Government Pleader would contend that, as along as X-ray equipments are not specifically shown in the registration certificate, the petitioner cannot be permitted to transport the goods under constructional rate. 2. In the circumstance of the petitioner being a W.P.(C) No. 13071 of 20147 2 registered dealer, without going into the contentions raised it is deemed fit that, the respondent be directed to release the goods on execution of simple bond without sureties expeditiously on production of the certified copy of this judgment. The proceedings if any initiated shall be proceeded within a period of six months.
With the above directions and observations, the Writ Petition stands disposed of.
