1. By way of this petition under Articles 226 and 227 of the Constitution of India, the petitioner workman has interalia challenged the present award rendered by the Presiding Officer, Labour Court, Vadodara in Reference (LCB) No. 323 of 1992 dated 14.5.2001 whereby the Labour Court, Vadodara was pleased to reject the said Reference. Being aggrieved by the said judgment and award the workman has preferred this petition.
2. The matter came to be admitted and at the time of final hearing, at the joint request of the learned Counsels appearing for the parties, an attempt was made to settle the dispute and the matter was kept for passing orders after full fledged hearing.
3. Today when the matter is called out Ms. E. Shailaja, learned Advocate appearing for the petitioner and Mr. Nisarg Desai, learned Advocate appearing for Nanavati Associates for Respondent No.1 state that they have been able to find out an amicable solution whereby the respondent Company has agreed to pay the amount of Rs. 15,000/- (Rupees Fifteen Thousand only) as a full and final settlement of the dispute which is the subject matter of the present petition. It was therefore jointly prayed that the petition may be disposed of in view of the above statement.
4. Considering the request made by the learned Counsels as aforesaid, the petition is disposed of. Respondent No.1 shall pay a sum of Rs.15,000/- (Rupees Fifteen Thousand only) to the petitioner by Account Payee Cheque drawn in the name of the petitioner within a period of four weeks i.e. latest by 15.05.2012. In lieu of the same the petition is disposed of accordingly. Rule discharged with no order as to costs.
