Heard Shri Virendra Singh, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner is seeking a direction to the respondents to release his medical bills amounting to Rs.1,23,940/-. In this regard the Additional Commissioner, Village Development, U.P. has already written a letter to the Project Director, District Village Development Tribunal, Varanasi on 30.08.2016 (page 55 of the writ petition) but it is stated that till date no order has been passed.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.4, Pariyojana Nideshak Gram Vikas Abhikaran, District Varanasi to take a decision in the matter in the light of the letter of the Additional Commissioner, Village Development, U.P. dated 30.08.2016 expeditiously preferably within a period of two months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
