Heard learned counsel for the petitioners, learned Standing Counsel and Sri P.R. Kannaujiya, learned counsel appearing for opposite party no.2.
By means of present writ petition, the petitioners are seeking a direction in the nature of mandamus commanding the opposite parties no. 2 to 6 to construct the School Building upon Gata No. 241 situated at Village Khanua, pargana, tehsil and district Raebareli.
Learned counsel for the petitioners invites attention of this Court towards the letter dated 01.06.2010, Annexure-7 to the writ petition, issued by the District Magistrate, Raebareli whereby he has asked the Sub-Divisional Magistrate, Sadar, district Raebareli to demarcate the land for the purpose of construction of school building and remove the encroachment. So far as construction of school building on any specific plot is concerned, it is prerogative of the district authority. Therefore, the dispute relating to a specific plot number cannot be adjudicated upon by this Court.
Let it be considered by the District Magistrate concerned and proceed with the matter for construction of school building expeditiously in accordance with rules.
Subject to the aforesaid observations and directions, the writ petition is disposed of finally.
