JUDGMENT / ORDER

Petitioner is the second accused in Crime No.171 of 2014 of the Hosdurg Police Station for the offences punishable under Sections 465, 468, 471, 406 and 420 of the Indian Penal Code, Section 20 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, apprehends arrest and has filed the application. 2. Learned Public Prosecutor has opposed the application. It is submitted that on 13.02.2014 at about 4 a.m. in the lorry belonging to the petitioner, river sand was unauthorizedly transported under pretext that the lorry is carrying onion. The bills and other documents were to the effect that the lorry was carrying 250 bags of onion. The bills and other documents were forged.
3. Learned counsel submits that the allegations are not true.
4. Having regard to the nature of allegations made the investigation required to be done, request for pre-arrest bail Bail Appl.No. 3311 of 2014 () 2 cannot be allowed.
5. Learned counsel requested that the petitioner may be allowed to surrender before the investigating officer.
6. Let the petitioner surrender before the investigation officer on 18.06.2014 and on other dates as directed by the investigating officer in case interrogation is not completed.
7. In case the the petitioner is arrested, he shall be produced before the Jurisdictional magistrate as early as possible where it is open to the petitioner to request for bail with intimation given to the Assistant Public Prosecutor concerned at least two working days in advance.
The application is disposed of as above.
