Heard learned counsel for the petitioner, learned State Counsel and learned counsel representing the Madhyanchal Vidyut Vitaaran Nigam Ltd.
By means of this writ petition, a prayer has been made to quash the recovery proceedings issued against the petitioner for recovery of certain electricity dues.
The petitioner has already approached Consumer Forum challenging the bill pursuant to which the recovery proceedings have been initiated.
Accordingly, petitioner by filing this writ petition seeks to pursue two parallel remedies for the same relief and as such in this matter, the writ petition would not be maintainable.
The writ petition, thus, dismissed, however, it will be open to the petitioner to pursue his remedy before the Consumer Forum, if it is legally tenable.
