1.0 Learned Special Public Prosecutor Mr. Panchal submitted that the enhancement appeal is filed in this case and the same is admitted by this Court. Besides, he submitted that in such cases, consistent view of the Court is that the convict should be released only with police escort at the cost of the convict himself.
2.0 The learned advocate for the applicant states that the applicant is willing to be released on Temporary Bail with police escort at his own cost.
3.0 Rule.
Learned Special Public Prosecutor waives service of process of Rule.
4.0 Taking into consideration the contents of the application, the application is allowed. The convict is ordered to be released on Temporary Bail for a period of 02 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities with police escort at his own cost.
4.1 The applicant - convict shall surrender to the jail authorities on expiry of the Temporary Bail period.
4.2 Rule is made absolute to the aforesaid extent.
