This petition has been filed by the petitioner praying for a direction to the Prescribed Authority/ Civil Judge (Senior Division), Lalitpur to decide the Rent Case No. 1 of 2016 (Siddharth Srivastava vs Ramsharan Lal Srivastava and others) pending before it since February, 2016.
It has been informed by the learned counsel for the petitioner that pleadings have been exchanged and the matter is ripe for hearing, and now for the past several dates, the matter is being fixed for hearing, but has not reached its conclusion.
Learned counsel for the the petitioner has referred to Rule 15(3) of U.P. Urban Building (Regulation of Letting, Rent and Eviction) Rules 1972, which provided that a release application should be decided as far as possible within two months from its presentation.
A copy of the order sheet has been filed as annexure to this petition. It is clear that for the past several dates, no orders on merits have been passed. It is not clear that arguments have also been heard or not. The orders noted on the order sheet are cryptic in nature.
This petition is disposed of with a direction to the Prescribed Authority/ Civil Judge (Senior Division) Lalitpur to consider and decide the release application within a period of two months from the date a certified copy of this order is produced before him.
