CITY CIVIL COURT, BANGALORE IN O.S.NO.7570/2014 AND CONSEQUENTLY RESTORE THE SUIT AS AGAINST DEFENDANT NO.1.
THIS PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R A memo is filed by the petitioner indicating thereunder that O.S.No.7570/2014 has been dismissed as not maintainable by order dated 16.03.2017.
2. Present writ petition is directed against the order dated 18.10.2016 – Annexure-E passed in O.S.No.7570/2014, whereunder suit came to be dismissed against first defendant. For the present writ petition is dismissed as having become infructuous. However, it is made clear that in the event of order dated 16.03.2017 is recalled or set side, writ petitioner would be at liberty to revive the present writ petition.
