Heard Sri Bharat Singh, learned counsel for the applicant and Sri Rajesh Srivastava, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is not named in the FIR and the person named in the FIR has been exonerated. It has been further submitted that the applicant was arrested during the course of investigation and have been falsely implicated. It has been next submitted that the two prosecution witnesses of the case did not support the prosecution case. The applicant is in jail since 18.3.2015.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Siddhari involved in Case Crime No. 318 of 2014 under Section 302, 120B I.P.C., police station Ughaiti, District Badaun.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of four months from the date of production of a certified copy of this order, if, there is no legal impediment.
