Short counter affidavit has been filed today on behalf of the Respondents No. 3 and 4, which is taken on record.
This writ petition has been filed, inter alia, for the following relief;
I. Issue a writ, order or direction in the nature of certiorari quashing the impugned notice dated 21.06.2018 issued by the Additional Chief Officer, Zila Panchayat, Bijnor (Annexure no. IV to this writ petition).
II. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents not to dispossess the petitioner from the shop No. 14 situated near Normal School Kachehary Road, East District Bijnor.
Heard Sri Arun Kumar Singh, learned counsel for the petitioner and Sri V. K. Dixit, learned counsel for the respondents and perused the record.
In paragraphs 8 and 9 of the short counter affidavit, it has been stated that the petitioner and co-tenant Ankur Bhatnagar have deposited the entire dues upto June 2018 and are now giving their undertaking that they will continue to deposit the dues regularly and the department does not want to take any further action as per the notice dated 21.6.2018, as such, the eviction notice dated 21.6.2018 has become infructuous.
In view of the above, we are of the opinion that no cause of action survives to the petitioner and no order is required to be passed in the present writ petition. Therefore, the writ petition is accordingly dismissed.
