JUDGMENT / ORDER

The petitioner is the owner of passport bearing No.F8478574. The petitioner had approached the passport authorities for correction of date of birth. The petitioner, by Ext.P2, has been directed to appear before the Passport Issuing Authority to furnish a detailed explanation regarding disparity in the date of birth along with the Court Order. It is challenging Ext.P2, the petitioner has filed this Writ Petition.
2. A statement has been filed on behalf of the respondents. It is stated that the petitioner initially produced the S.S.L.C. book to evidence his date of birth. Now, the petitioner wants to rely on the birth certificate as well as S.S.L.C. Book. Therefore, the petitioner has to W.P.(C) No. 28725/2014 -2-
explain, by appearing before the Passport Issuing Authorities, the reasons of differences in various documents. It is also submitted that the difference is more than four years.
3. This Court in Nizar V. Union of India - 2014 (4) KLT 609 held that even if the disparity is more than two years, the Passport Issuing Authority has power to correct the date of birth, on being satisfied with the genuineness of the certificates. Therefore, passport authorities can correct the date of birth in the passport, subject to satisfaction of the certificates.
4. In the above facts and circumstances, the petitioner shall appear before the Passport Issuing Authority along with this Court Order and explain reasons for differences in the date of birth and on being satisfied with W.P.(C) No. 28725/2014 -3-
the genuineness of the documents relied by the petitioner, necessary action shall be taken by the passport authorities in accordance with law.
The Writ Petition is disposed of accordingly.
