Petitioner's vehicle bearing Reg. No. KL-50-A-9567 had been seized by the 1st respondent on 22.5.2012 on the allegation of transportation of river sand. According to the petitioner, the aforesaid allegation is absolutely baseless. 2. Whatever that might be, in view of the fact that already proceedings had been initiated pursuant to the allegation that the petitioner has violated the provisions of Kerala Protection of River Banks and Regulation of Removal of Sand Act, it is for the R.D.O. to take appropriate proceedings in the matter.
3. The petitioner has submitted Ext. P3 representation before the RDO for testing of the sand and Ext. P 4 is for release of the vehicle and for completing the adjudication.
4. Having regard to these factual statements, I am of the view that this writ petition can be disposed of as under: The RDO is directed to conduct necessary enquiry and pass appropriate orders in accordance with Exts. P3 and P4 W.P(C) No. 15013 of 2014 -: 2 :-
and complete the procedure within six weeks from the date of receipt of a copy of this judgment.
