JUDGMENT / ORDER

It is submitted by the learned counsel for the appellant that the appeal is not pressed. 2. He submits that the District Collector is taking steps to realise the court fees from the appellant. The decree allows the appellant to recover Rs.25,000/- from the second defendant and Rs.35,000/- from the third defendant. So far no amount has been paid to the appellant, the only request of the appellant is that the court fee may be realised from her only if the amount is realised. I think the request is reasonable.
In the result, it is directed that the court fee payable on the plaint shall be a first charge on the amount payable under the decree and it will be realised only if the decree amount is recovered or paid.
