JUDGMENT / ORDER

Petitioners were sureties for the accused in Sessions Case No.788 of 2010 on the file of the Additional Sessions court, II, Mavelikkara. On the failure of the accused to appear before the Court notice was issued to the appellants to appear and show cause why they should not be ordered to pay the amounts covered by the bonds executed by them. They did not respond to the notice. The learned Sessions Judge ordered them to pay the bond amount of Rs.25,000/- as penalty. This order is challenged on the ground that no sufficient opportunity was given to the appellants. 2. Heard.
3. There is no dispute that the appellants were served with notice on the failure of the accused to appear before the trial court. They did not respond to it. They cannot be heard to say that they were given sufficient opportunity to show cause why they should not be ordered to pay the penalty. I find nothing wrong in the order passed by the learned Sessions Judge. It is submitted by the learned counsel for the appellants that the amount may be reduced. I am not of the opinion that the amount is very high having regard to nature CRL.APPEAL No.14 OF 2014 2 of the case and the allegations against the accused. There is no reason to interfere with the order passed by the learned Sessions Judge.
In the result, this Criminal Appeal is dismissed.
